REPRESENTATIVE TRIAL AND APPELLATE EXPERIENCE

Alien Tort Claim Act: The dismissal for lack of federal subject matter jurisdiction of a lawsuit involving claims by six Guatemalan nationals against three affiliated companies under the Alien Tort Claim Act, 28 U.S.C. § 1350, the Torture Victim Protection Act of 1991, 28 U.S.C. § 1350, note, and/or the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1961 et seq. (“RICO”). (This favorable decision is the subject of a pending appeal before the United States Eleventh Circuit Court of Appeals).

Corporate Shareholder Dispute: In a successful appeal, we obtained the reversal of a trial judgment improperly awarding a terminated employee over $200,000 under a shareholders’ agreement.

Improper Lender Practices: Obtained summary judgment against a major institutional lender thwarting an attempt by that lender to improperly recover under a conditional and escrowed guaranty agreement.

Wage & Hour Class Action: Defense and successful settlement of a class action wage and hour suit brought against a national food distributor and owner of nationwide retail grocery stores.

Protection of Lender Security Interests: Obtained summary judgment in favor of a rental car agency’s lender as taking first priority over other lenders under Chapter 319 of the Florida Statutes dealing with Motor Vehicles.

Commercial Mortgage Foreclosures: Successful prosecution of over 100 complex commercial mortgage foreclosures on behalf of institutional and non-institutional lenders throughout the State of Florida and nationwide.

Accountant Liability: Defense and prosecution of accountant malpractice cases.

Commercial Landlord-Tenant Dispute: Six-day jury trial and appeal of irreconcilable lease provisions.

Attorneys Fee Dispute: Trial and appeals of fee dispute of contingency fee agreement.

Directors & Officers’ Liability: Prosecution and defense of suits against corporate officers and directors.

Mindy Lee Pallot is a native Miamian with a strong commitment to South Florida’s commercial growth. Mindy has represented clients in a variety of complex civil matters involving international civil rights violations, class action labor litigation, shareholder derivative claims, RICO, commercial landlord-tenant matters, professional liability, commercial insurance coverage, fraud, and various other business torts. She has specialized in the representation of commercial lenders (institutional and non-institutional), including foreclosure litigation and work-outs of troubled loans. In addition, Ms. Pallot also serves as general counsel for several South Florida businesses, including a large international provider of cable and satellite network carriage services, a provider of software services to the automotive industry, and an international chain of furniture stores.

Mindy is a graduate of the University of Florida (B.S., 1982) and the University of Florida College of Law (J.D., 1995), where she was an editor of the University of Florida Law Review. Mindy has worked with some of South Florida’s most respected national and local firms as a commercial litigator in state and federal courts, at both trial and appellate levels. She is a member of the Florida Bar and of the Bars of the United States Court of Appeals for the Eleventh Circuit and the Southern and Middle Districts of Florida.
